You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms (including, where applicable, entering into a paid subscription).

Resonant Swell provides surf forecast information for coastal spots in Oregon and Washington, generated by a proprietary geological scoring model. The Service is offered in multiple access tiers (free, forecaster, and pro), each with different spot access and forecast depth, as described on the Service.

Ocean conditions are inherently dangerous and can change rapidly and unpredictably.

Forecasts, scores, hazard information, and all other content provided through the Service are estimates generated from third-party data sources (including NOAA, Open-Meteo, PacIOOS, and Copernicus Marine Service) and our own modeling. They are provided for informational purposes only and:

• Are not a guarantee of actual, current, or future ocean, surf, weather, or safety conditions at any location;
• Are not a substitute for your own on-site judgment, local knowledge, official government or lifeguard advisories, or professional safety guidance;
• May be inaccurate, delayed, or based on incomplete data.

You are solely responsible for your own safety decisions. Never enter the water based solely on information from this Service. Always assess actual conditions in person, respect posted warnings, and use your own judgment.

Assumption of Risk. Surfing, and ocean and coastal activities generally, carry inherent risks of injury, death, and property damage — including risks from waves, currents, marine life, submerged hazards, and weather — regardless of the accuracy of any information provided through the Service. By using the Service, you voluntarily assume all such risks. This assumption of risk applies independently of, and in addition to, any disclaimer regarding the accuracy of forecasts or other Service content. Cascadia Apps disclaims all liability for injury, death, or property loss connected to your use of the Service or your participation in any water or coastal activity, whether or not related to information provided through the Service. See Section 9 (Disclaimers and Limitation of Liability) below.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at hello@cascadiaapps.com if you suspect unauthorized use of your account. You may not share your account or create an account on behalf of someone else without their permission.

• Paid tiers (forecaster, pro) are billed on a recurring subscription basis. Pricing is displayed on the Service at the time of purchase and may change with reasonable notice for future billing periods.
• Payments are processed by Stripe, Inc. We do not collect or store your full payment card details.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain access to your paid tier through the period you've already paid for, and you will not be charged again.
• We do not currently offer refunds for partial billing periods, except where required by law.
• Merchandise (swag) orders are final once placed — we do not offer refunds or exchanges for incorrect size selections.

If you submit photos, spot information, or other content through the Service ("User Content"), you retain ownership of it. By submitting User Content, you grant Cascadia Apps a non-exclusive, worldwide, royalty-free license to use, store, display, and process that content for the purpose of operating and improving the Service (including verifying submissions against forecast and buoy data).

You represent that you have the right to submit any content you provide, and that it does not violate any third party's rights. We may remove User Content or restrict your ability to submit it (including revoking access to submission features) at our discretion, including in cases of misuse or abuse.

Photo submissions may include embedded metadata (such as location and timestamp) that you provide as part of the submission process — see our Privacy Policy for how this data is used.

You agree not to:

• Attempt to reverse-engineer, scrape, or extract the underlying forecasting model, scoring algorithms, or proprietary data;
• Circumvent access-tier restrictions or share paid-tier access with unauthorized users;
• Submit false, misleading, or abusive content through Log Session or Submit Spot;
• Use the Service for any unlawful purpose or in a way that could damage, disable, or impair it.

Violation of this section may result in suspension or termination of your account, including revocation of specific features (such as submission access) without full account termination.

The Service, including its forecasting model, scoring methodology, design, and underlying software, is the property of Cascadia Apps LLC and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, branding, or proprietary technology outside of your ordinary use of the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASCADIA APPS LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF LIFE, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Service or other users. You may stop using the Service and delete your account at any time by contacting us.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (such as an on-site notice or email). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law principles.
